Rent a Date for Charity Ltd. (we / us / RDC) are committed to protecting and respecting your privacy.

This policy (together with our terms of Website use and any other documents referred to in those terms of Website use and membership terms) (the Website Terms) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.  Please read the Website Terms and the following policy carefully to understand our views and practices regarding your personal data and how we will treat it.  By using our Website and our services and by continuing to do so, you indicate your agreement to our use of your personal data as set out in this privacy policy.

Definitions

Act means the Data Protection Act 1998 as amended from time to time together with all regulations made in accordance with it;

Auction means an auction conducted through this Website;

Bid means an amount of money bid by a Bidder in an Auction;

Bidding means the process of pledging a Bid in an Auction;

Bidder means a User who bids in an Auction;

Candidate means a User who has also applied and been accepted by RDC to display their Profile and photographic image on the Website as part of an Auction and to attend a date with the Winner; italso includes Celebrity Candidates;

Celebrity Auction means an Auction featuring a Celebrity Candidate;

Celebrity Candidate means Lisa Connell or another individual Candidate who is also a celebrity who has agreed to participate in a Celebrity Auction and a date with the Winner of the Celebrity Auction in accordance with the Website terms and any agreement entered into between RDC and the celebrity;

Content means any content, information, messages, photos or Profiles submitted by Users;

Designated Charity means the charitable organisation(s) identified on the Website webpages and which support research into brain tumours or which fund treatment or provide support to brain tumour sufferers and their loved ones;

Donor means a person or an organisation which has donated an item, event or services to be auctioned or sold in a fixed-price sale via the Website;

Profile means the User’s publicly displayed profile including, without limitation, user name, location information, age, gender, sexual orientation, photographic image and dating preferences;

RDC means Rent a Date for Charity Ltd.;

Service(s) means the Website, the auction facility and any other interactive services available on the Website;

Website Terms means the general terms and conditions which apply to your Use of the Website, the additional Items Auction and Fixed Price Sale terms and all other documents referred to therein;

Use / Using means any use of the Website or the Services including, but not limited to registering as a User, Candidate or Donor, viewing Profiles or item descriptions, participating in Auctions; uploading, updating or amending Content or Profiles, sending or posting messages to RDC or other Users

User means any person who registers their details whether as a Bidder or as a Candidate with the Website and thereby agrees to comply with these Terms.

Website means the website www.rentadateforcharity.com.

Winner means the Bidder who has placed a bid which (i) exceeds the reserve applicable to that Auction; and (ii) which is the highest eligible bid at the time the Auction closes.

For the purpose of the Act, the data controller is Rent a Date for Charity Ltd., a company registered in England and Wales with registration number 6360800 and its registered office at 39 Alma Road, St Albans, AL1 3AT.

Scope of this privacy policy

This policy only applies to how we deal with your personal information (or “personal data”), both the information which you knowingly chose to disclose to us and other information we collect from you as you interact with our Website and with us via other means of communication such as the telephone, email, post, SMS or fax. 

This policy does not apply to any other company or to any other company’s websites even if you access them through our Website nor does it apply to any information you chose to disclose to another User.  If you disclose your personal data to other companies your information will be dealt with according to their privacy policies and practices.  We accept no responsibility or liability for other companies’ use of your personal data nor do we accept any responsibility or liability for other Users use of your personal data.

Information we collect from you

We may collect and process the following data about you:

  • Information that you provide by filling in forms on our Website http:///www.rentadateforcharity.com . This includes information provided at the times of registering as a User, creating a Profile, registering yourself as a Candidate or a Donor, Bidding, subscribing to and using our services, posting Content or requesting further services.
  • If you contact us, whether by email, post, fax, telephone or SMS, or if we contact you, similarly we may keep a record of that correspondence.
  • We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them.Details of your participation in an Auction whether as a Candidate or as a Bidder as well as details of any payments you make to us and any other transactions you carry out through our Website.
  • Details of your visits to and Use of our Website including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own fundraising or billing purposes or otherwise and the resources that you access on or via our Website.
  • If you enter into any of our other non-Auction competitions or promotions, we may ask for additional information about you. We may process this information for other purposes and if so we will also inform you of those purposes at that time.
  • We collect information in aggregated form from visitors and Users of our Website to help us to make improvements to the Websites and to the services we make available. We know, for instance, how many visitors there are to our Website, when they visited, for how long and to which areas of our Website they went. We may use this information to manage our Auctions and we may share it with the Designated Charity and with other advertisers and other companies which offer their goods or services on our Website. It helps to show these organisations how effective our Websites are in connection with their fund raising activities or as sales channels for their products (as the case may be). However you or any other individual cannot be identified from the information we share as the data is aggregated and anonymised.

What information is published on the Website or made available to other Users?

When you create a Profile your User name, location information, age, gender, sexual orientation, photographic image and dating preferences will be available to other Users and to members of the general public who may visit the Website and when you upload Content which includes personal information in connection with your use of the Website and our interactive services (including but not limited to the Auction services) you will be making that personal information publicly available to all other Users and members of the general public who visit our Website and you do so at your own risk.  At the present time there is no feature on our Website which allows you to suppress any of the information referred to above from your Profile as we believe that these matters are essential information to ensure that your Auction and the resulting date is a success and you are only eligible to participate in an Auction (whether as a Bidder or as a Candidate) if you agree to the processing of this personal information in this manner.

Please also be aware that even after your Profile has been removed, copies of personal information you have chosen to upload to the Website may have been copied and stored by other persons.

By providing this date for your Profile you consent to our processing of your ‘sensitive personal data’ such as your ethnicity, radial information and sexual orientation for the above purposes.

Your personal email address will also be made available to the other Users who are parties to transactions with you via our Website (i.e. to the Winner, the Candidate or Donor, as the case be, in connection with an Auction you participated in order that arrangements for the date or the delivery of the item, event or service may be made). We accept no responsible for other Users’ use of your personal information.  If you do not wish to expose yourself to risk you should refrain from participating in Auction or Fixed Price Sale services.

In accordance with our Website Terms, you must not include in your Profile any personal contact information, including but not limited to, telephone numbers, street addresses, last names, URLs or email addresses and if you do disclose such information you do so at your sole risk and any such disclosure is a breach of the Website Terms and the remedies which are set out in those Website Terms shall apply.

Any improper collection or misuse of information is a breach of the terms of Website use and should be reported to support@rentadateforcharity.com.

Once this information is made available on the Website we will not be responsible for any use which is made of this information. 

IP addresses and cookies

We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users' browsing actions and patterns, and does not identify any individual.

For the same reason, we may obtain information about your general internet usage by using a cookie file which is stored on the hard drive of your computer. Cookies contain information that is transferred to your computer's hard drive. They help us to improve our Website and to deliver a better and more personalised service. They enable us:

  • To estimate our audience size and usage pattern.
  • To store information about your preferences, and so allow us to customise our Website according to your individual interests.
  • To speed up your searches.
  • To recognise you when you return to our Website.

You may refuse to accept cookies by activating the setting on your browser which allows you to refuse the setting of cookies. However, if you select this setting you may be unable to access certain parts of our Website. Where we store your personal data

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

All information you provide to us is stored on our secure servers or those of our third party suppliers – see Disclosure of Your Information below.

Where we have given you (or where you have chosen) a password which enables you to access certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Website; any transmission is at your own risk.

Storage Period

We will store your personal data for so long as you are a User.  After you cease to be a User we will keep your personal data on our records for a period of one year to enable us to respond to any queries or complaints that you may have.  After this time we will delete all of your personal data from our records, apart from any data that we are required to keep for legal reasons, for example we will need to keep your billing data for 7 years in accordance with Inland Revenue rules.

Uses made of your personal data

We use information held about you in the following ways:

  • To ensure that content from our Website is presented in the most effective manner for you and for your computer.
  • To help us to operate the Website efficiently.
  • To provide you with information, products or services that you request from us.
  • To carry out our obligations arising from any contracts entered into between you and us.
  • To allow you to participate in Auctions, messaging and other interactive service available on our Website, when you choose to do so.

  • To make operational communications to you.
  • To make service-related communications to you.
  • To communicate with you in relation to your application to register as a User of our Website.
  • To communicate with you in relation to your application to register as a Candidate.
  • To communicate with you and the Winner or the Candidate (as the case may be) in relation to Auctions, your participation in them and the outcome of them.
  • To investigate and respond to any complaints which may be made in connection with your Use of our Website, your participation in an Auction, your participation any date which may take place thereafter or your conduct towards another User.

By registering as a User you agree to the processing of your personal data for the above purposes.

Other Purposes - Publicity

We may also use your personal data to promote our Website in accordance with the Website Terms (see the section Publicity).

By registering your Profile and by participating in an Auction you expressly agree to the processing or your personal data for publicity purposes.

Other Purposes - Promotions

We may also use your data, to provide you with information about events, goods and services we offer or which are offered by the Designated Charity which we believe may be of interest to you and we may contact you about these by post, telephone, SMS, email or fax for these purposes.

We will not, other than as set out in this privacy policy, pass on your data or permit third parties to use your data. 

If you do not want us to use your data in this way, please tick the relevant box situated on the form on which we collect your data (the registration form).

Advertisers

We do not disclose information about identifiable individuals to our advertisers, but we may provide them with aggregate information about our users (for example, we may inform them that 300 women aged under 30 have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target. We may make use of the personal data we have collected from you to enable us to comply with our advertisers' wishes by displaying their advertisement to that target audience.

Processing of payments

When you make a payment to RDC you will be directed to Paypal. Paypal will ask you to provide personal details including financial information to them so that they may process your payment, all personal data you provide to Paypal will be governed by their data protection and prvacy policy.  We accept no liability for any use made by Paypal of any personal data you provide to them.

Disclosure of your information

We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 736 of the UK Companies Act 1985.

We may disclose your personal information to third parties:

  • To other Users where those Users are either the winning Bidder of an Auction in which you have participated or the Candidate in an Auction in relation to which you are the winning Bidder.
  • To the representatives of a Celebrity Candidate where you are the winning Bidder in a Celebrity Auction.
  • To our group companies and to those suppliers to whom disclosure is necessary for the operation of our Website or any of the services.  Please note that we require any third party suppliers to process and store your data securely and they are prohibited from using it for any other purpose.
  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
  • If Rent a Date for Charity Ltd. or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of Website use and other agreements; or to protect the rights, property, or safety of Rent a Date for Charity Ltd., our members, our guests, or others. This includes exchanging information with other companies and organisations for the purposes of fraud and crime protection and credit risk reduction.
  • Where you are the winning Bidder in a Celebrity Auction we may also disclose your personal information to the Celebrity Candidate and / or their agent or representative in accordance with our agreement with the Celebrity Candidate.  The Celebrity Candidate and / or their agent or representative will process your personal information in connection with the arrangements for your date and in connection with any reasonable identity and / or security checks they may conduct.  As with any other third party processor we will require that these people process and store your data securely and they are prohibited from using it for any other purpose.

The Celebrity Candidate and / or their agent or representative may request your permission to process your personal data for other purposes, if consent to this then any use of your personal data by the Celebrity Candidate and / or their agent or representative is a matter for you and them and RDC and / or the Designated Charity shall have no responsibility or liability therefore.

Your rights

You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data.  You can also exercise the right at any time by contacting us at support@rentadateforcharity.com.

Access to information

The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.

How to access and update your email preferences, personal information and public information

You have the opportunity to opt-out of certain communications and to modify the non-public personal information you or the public information in your Profile at any time by going to the “My Account” or “My Profile” section of the Website.  Please be aware that it may take several hours for the change you make to take effect in the public areas of the Website.  Please note that any changes will only change or delete data in our database for the purposes of future activities and communications.

Changes to our privacy policy

Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by e-mail.
